I posted this to my journal, but since I found my works and works from [livejournal.com profile] kaige68, [livejournal.com profile] haldoor, and [livejournal.com profile] sharpiesgal on the site, I thought I would share this with the community as a whole.

We’ve been getting pings and @’s all morning about ebooks-tree.com who seem to be scraping/taking stories off of AO3 and hosting them as PDFs and mobi downloads on their site; the site seems to be pulling from UrBookLibrary as well. They’re not reading your “do not copy/duplicate” notes on your AO3 fic; their bots are pulling things directly from AO3, without AO3′s authorization or assent. It looks like they are pulling from Wattpad too, again without authorization or assent.

While the Ebooks-Tree DMCA page seems to imply that you need a lawyer or other “authorized person” to submit a takedown notice, you don’t; you can do it yourself.

As we’ve posted before, fanfic writers hold copyright in their stories, although not in lines/quotes from the works they’ve been inspired by, and because of that, fanfic writers can submit DMCA takedown notices, or have someone do it on their behalf. While this post isn’t legal advice (none of our posts on FYC are), you might want to consider using this template (well, the bolded bits) in telling ebooks-tree to take down your content:
Your Name and/or Pseudonym as an e-signature (or the name of the person you’ve authorized to submit this request, with a slash before it and after it)
Link(s) to the unauthorized works (link to the pdf, the mobi and the page hosting all of it)
Link(s) to an authorized version of your work (whether on AO3, tumblr, LJ or somewhere else)
An email address of the submitter (include it again even if it’s in the header)
This statement: I have good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
This statement: The information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

tumblr user besinaao3 offers us this advice:

Cut and paste that into their contact form and make sure that you make the subject line read: “DMCA Complaint” or they won’t process it.

you can also send an e-mail to their host: Response from Moniker: The best way to handle that is to contact our abuse team at abuse@moniker.com. They will be able to assist you or point you in the correct direction for legal matters such as this. This chat line is not equipped to handle matters of a legal nature such as this.

April 14 Update: (Information collected from [livejournal.com profile] iulia_linnea)

Please be advised that Ebooks Tree's URL no longer ends in .com (ebooks-tree.com); it now ends in .net (ebooks-tree.net). Further, ebooks-tree.com now redirects to ebooks-tree.net. I believe that this change may have been made by Ebooks Tree to avoid having to take down stolen material, which means that in order to have stolen material removed from the site, one needs to submit a DMCA complaint letter to abuse@moniker.com (Moniker is Ebooks Tree's hosting site) with the altered links to one's works.

When I search for my name, I no longer find any works listed for me on an author's page. Though Iulia still get the link to the 'full version' on her check and takes her to the sign up gimmie your credit card information.

I agree with her, the site is more than a little hinky and full blown stinky.

Ten of mine are in there - a weird mishmash of stuff, not necessarily the better of them at all. Very odd. I can say that the AO3/OTW folks were discussing it and put out a post on their own sites saying they are deciding whether to approach the matter on behalf of writers. Part of me hopes they do - certainly would be better than individuals having to approach it one at a time.

This isn't unusual in the web world - the commercial news web site I manage often has its headlines scraped by 'aggregator' sites. Each one needs to be fought off and beaten down. Eventually they give in.

Thank you! I'm not in the author list, but put myself in the search bar and they have five of my fics. Utterly ridiculous.

eta: decided to go back and check under elle andrews patt as well and while it says 0 books, it has a download titled elle andrews patt.pdf (full version). Of course, I didn't download, but what the hell???

Jeez, this is crazy. Look how many of us have been affected! Thank you so much for pointing this out - I had thirty works there, and such random ones it wasn't funny (only parts of some full stories in some cases due to posting in parts instead of chapters, I suppose). I've sent them an email too, same thing - asking them to take my works down.

Let's hope this is over very soon. Thanks again.

I'm curious if they'll actually remove the files/books from authors who send in a complaint. What would be the next step, if nothing's done? Retain an attorney?

If that site is now switching over to .net instead of a .com tells me they're not going down without a fight. They could very easily just rename the site entirely with the files/books still there.

I would be sketchy about them removing people because they ask. I have disappeared from the list, and haven't had a chance to write my 'please unsteal my fic' letter yet. But perhaps AO3 sent an nasty and they took it down.
